Common Grand Rapids Motorcycle Accident Questions

Our Michigan motorcycle accident lawyers represent bikers and passengers injured in Michigan motorcycle accidents. The following are some commonly asked questions of our motorcycle accident attorneys.

If I was driving a motorcycle or was a passenger on a motorcycle that was struck by an automobile in Michigan, can I sue the driver and the owner of the automobile that cause the accident for my injuries?

Yes, if the following two criteria are fulfilled. First, is the driver of the automobile at-fault? Second, did you sustain a serious injury or disfigurement (like a scar) from the crash? If both are true then the automobile driver can be sued

How much time do I have to sue the driver and owner of the automobile or motorcycle that caused the Michigan motorcycle accident?

Usually you have three year from the date of the accident to file a lawsuit with the court. However, it is recommended that you contact an attorney immediately to discuss any time limitations in suing the driver of the at-fault driver and owner of the automobile or motorcycle that caused the accident, and to insure your rights are protected.

What if the other driver was driving another motorcycle rather than an automobile in Michigan?

Yes, and unlike above you do not need to prove you suffered a serious injury or disfigurement, only that the other driver is at-fault. At this point you can then sue the other driver for all your injuries and damages. A claim is made against the driver and owner of the motorcycle that caused the accident, and your damages are covered by their insurance company.

What if the driver and owner of the automobile and/or motorcycle that caused my injuries did not have liability insurance at the time of the motorcycle accident?

You may still recover compensation for your personal injuries. This depends on whether you were occupying a motorcycle which had uninsured motorists coverage or you were covered by your own insurance policy or a family member’s insurance policy which had uninsured motorist coverage at the time of the accident. This is called an Uninsured Motorists Claim.

It is recommended to contact an attorney immediately to find out time limitations, policy requirements which must be met under this claim, and to ensure your rights are protected.

Grand Rapids Motorcycle-Car Accident

Our Grand Rapids car accident lawyers are reporting a story in the paper today about a Grand Rapids motorcycle accident that left one person injured.  The accident took place on Thursday, August 26th, in the p.m. hours.  According to police, the accident that took place at the intersection of Division Avenue NW and Pearl St. NW was between a sedan and a motorcycle. One person was taken to the hospital and suffers injuries.

I am very sorry to hear about this accident and hope the injured victim has a fast recovery without any permanent damages.

Our Grand Rapids accident injury lawyers advise victims of their legal rights. The injured individual can submit a claim for Michigan No-Fault insurance benefits. No-Fault benefits will cover their medical expenses, lost wages, attendant care, replacement services, and other benefits related to injuries suffered in the accident. The injured person can claim these benefits even if they did not have a Michigan automobile insurance policy.

In addition, the accident injury victim may also have claims for personal injuries against the driver determined to be at fault in this motorcycle-car accident. The insurance company for the negligent driver typically pays a settlement for this type of case. In this lawsuit, the injured victims can claim damages and compensation for the injuries suffered in the accident.

Biker Killed by Suspected Drunk Driver in Grand Rapids

I heard a tragic story on the news over the weekend about a biker killed by suspected drunk driver in Grand Rapids. According to the Grand Rapids Police, Stafford Ray was travelling on Division Avenue near Labelle when a 2003 Ford Mustang allegedly struck his 1997 Kawasaki motorcycle as it turned onto Labelle. Ray’s motorcycle caught fire and he died on the scene. Police state that the Mustang was allegedly driven by Ronald Windom, who was driving on a suspended license. Police suspect that alcohol was involved and continue to investigate this tragic accident.

I  am very sorry to hear that this tragic and fatal motorcycle accident happened. My condolences go out to the family and friends of the biker.

Our Michigan motorcycle accident lawyers  advise bikers of their legal rights.  Because this motorcycle accident involved contact with another motor vehicle, the biker would have been eligible for Michigan No-Fault Insurance benefits.  These benefits provide for payment of medical expenses, lost wages, attendant care services, and other benefits.  Family members may also may be able to make a claim for Survivor Loss Benefits.  This can include payment of funeral expenses, lost wages, and loss of other services.

Also, the family members of the deceased victim may have a claim for a Michigan wrongful death lawsuit against the driver that police determine was negligent and caused these car accidents. Another possible claim would be a potential Michigan dram shop case against the seller or furnisher of the  alcohol before the accident.  At the very least, the surviving family should hire the best possible lawyer to look into these possibilities.

For a complete explanation of the rights of injured bikers in Michigan, you should request our FREE BOOK, “The Ultimate Michigan Motorcycle Accident Handbook.” Furthermore, the surviving family members may have a claim against the driver of the motor vehicle for wrongful death of the bikers. Grand Rapids Motorcycle Accident

I read a story today in paper about a serious injury that the organizer of Bikestock, Michael Trufflemire, sustained in a Grand Rapids Motorcycle Accident recently.   According to Trufflemire, he sustained a broken leg and ankle when a minivan turned in front of his bike and he was unable to stop before crashing into the side of the van.

I am sorry that this accident happened and wish Mr. Trufflemire a fast recovery.  This is a typical example of bikers being injured on Michigan roadways due to negligent driving of a motorist.  The injuries suffered in these accidents are often catastrophic.

The injured biker may be entitled to Michigan No-Fault Insurance Benefits since the accident involved contact with another motor vehicle.  This would provide for payment of medical expenses, lost wages, attendant care services, and other benefits.  For a complete explanation of the rights of injured bikers in Michigan, you should request our FREE BOOK, “The Ultimate Michigan Motorcycle Accident Handbook.”
