Fatal Courtland Township Car-Trailer Accident

There was a story in the paper today about a fatal Courtland Township car-trailer accident that occurred Tuesday, October 27th in Kent County. According to the Kent County Sheriff’s office, the accident occurred 10 Mile Road NE when a Grattan Township woman’s 2006 Mercury Mariner was allegedly crashed into by a runaway trailer, filled with scrap metal. The trailer allegedly unhooked from a van traveling on 10 Mile Road near Je-Ne-Be Drive. A female passenger in the Mariner was seriously injured as well. The driver of the Mariner was rushed to the local hospital where she died the next day. The passenger was treated for non-life threatening injuries. Police believe that a metal pin holding the trailer came loose or failed causing the towing mechanism to come apart. Police are still investigating this accident.

I am very sorry to hear about this tragic accident and offer the family of the deceased Grattan Township woman my most sincere condolences and best wishes. I hope that the injured passenger has a speedy and complete recovery without any permanent deficits.

Our Michigan car accident lawyers advise accident victims of their legal rights. For this type of auto accident in Michigan, the injured passenger can submit a claim for Michigan No-Fault insurance benefits.  No-Fault benefits will cover her medical expenses, lost wages, attendant care, replacement services, and other benefits related to injuries suffered in the accident.  The injured party can claim these benefits even if she did not have a Michigan automobile insurance policy.

Additionally, for this type of auto accident in Michigan, the family members of the deceased Grattan Township woman may be able to make a claim for Survivor Loss Benefits. This can include payment of funeral expenses, lost wages, and loss of other services.

In addition, the injury victims may be able to file a lawsuit against the persons determined to be at fault in auto accident. The insurance company for the driver must still cover any injuries. In this lawsuit, the injured passenger and the family of the deceased victim can claim damages and compensation for the injuries suffered in the accident. The insurance company for the negligent driver typically pays a settlement for this type of case.

Also, the family members of the deceased Grattan Township woman may have a claim for a Michigan wrongful death lawsuit against the driver that police determine was negligent and caused this accident. At the very least, the surviving family and injured parties should hire the best possible lawyer to look into these possibilities.

An experienced Michigan car accident lawyer can assist the victim with this type of claim. Accident victims should not speak with the insurance adjuster for the negligent driver before consulting with an attorney.

Kent County Motorcycle Accident

A Courtland Township man was killed in a Kent County Motorcycle Accident on July 14th in Cedar Springs. According to police, they allegedly found Robert Polovich  lying near his 1997 Harley-Davidson on South Main Street Tuesday Evening.   Police state that Polovich was riding on South Main Street through a construction zone when he apparently lost control of his bike and crashed.  He was rushed to the hospital with serious injuries and eventually died from those injuries. Police are still investigating the accident.

I am sorry that this accident happened.  I offer my most heart felt condolences to his family for their tragic loss.

I  feel that it is important for those families of a person killed in a motorcycle accident to know their legal rights.  Because the full investigation is not completed, it would be speculative to discuss hte legal rights of the family.  However, if the investigation reveals that there was a defect in the roadway that made it unsafe for travel, there may be a possible lawsuit against the government agency responsible for maintaining the roadway.

Michigan law imposes strict deadlines for filing these claims and notifying the government agencies so it is essential to contact an experienced lawyer right away.
